In a move that could significantly change the administrative functioning of the Supreme Court of India, software powered by Artificial Intelligence will take over case listing and bench allocation. According to a report by Bar and Bench, the system is expected to reduce human intervention in the process.
This comes weeks after Delhi hosted the AI Impact Summit.
Decision by Chief Justice Surya Kant
The decision was taken by Chief Justice of India Surya Kant, as per reports.
At present, cases are allocated to different benches by the Chief Justice, who is known as the master of the roster. This power often brings the office of the Chief Justice under close scrutiny.
Administrative probe and registry changes
The reforms follow an internal probe that found two major systemic failures within the Supreme Court registry. Officials had remained in the same positions for long periods, and outdated technological infrastructure had allowed administrative lapses, including irregular and improper case allocation.
The registry has also seen an unprecedented wave of interdepartmental transfers of officials to address years of entrenched incumbency and inefficiency. A second round of transfers is expected before the end of the month.
What triggered this move?
The issue came to light during proceedings before a bench of Chief Justice Surya Kant, Joymalya Bagchi and Vipul Pancholi. The bench was hearing a petition filed by Irfan Solanki challenging the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986, on grounds that it conflicted with Section 111 of the Bharatiya Nyaya Sanhita, 2023.
During the hearing, the Government of Uttar Pradesh informed the court that a similar challenge had already been dismissed in the case of Md. Anas Chaudhary v. State of Uttar Pradesh. The matter had earlier been decided by a three-judge bench comprising former Chief Justice D. Y. Chandrachud, P. S. Narasimha and Dipankar Datta on December 12, 2022.
Despite that dismissal, a similar petition appeared before a fresh bench. Chief Justice Surya Kant took strong exception to the lapse. Senior Advocate Shoeb Alam sought to withdraw the plea, but the court directed that the matter would remain pending and be taken to a logical conclusion.
The Chief Justice also announced that a deeper administrative probe would follow.
