Minnesota Vikings defensive coordinator Brian Flores can now continue his racial discrimination lawsuit against the NFL and three teams in open court. On August 14, 2025, a federal appeals court in New York ruled the league's arbitration process invalid; otherwise, it could have stopped his case.
Initially filed in February 2022 against organizations including the New York Giants, Houston Texans, and Denver Broncos, Flores asserted that head coach hiring discriminated against him. This decision allows his ideas to be openly broadcasted. According to Flores’ attorneys Douglas Wigdor, David Gottlieb, and John Elefterakis, the NFL’s arbitration is “biased and unfair.”

The Second U.S. Circuit Court of Appeals in Manhattan agreed with a 2023 ruling from U.S.
District Judge Valerie Caproni. Judge Caproni had said Flores’ claims should not be forced into the NFL’s private arbitration, which gives Commissioner Roger Goodell power over disputes. The appeals court confirmed that this arbitration is “plainly unenforceable” because it lacks fairness and independent oversight.
Brian Flores’ lawyers- Douglas Wigdor, David Gottlieb, and John Elefterakis called the ruling a major win, saying it is important not just for NFL employees but for all workers seeking fairness and transparency.
They said the NFL’s arbitration was “biased and unfair”, and this decision sends a strong message that such practices cannot continue. NFL spokesperson Brian McCarthy responded by saying the league disagrees and plans to appeal the ruling. This is the second legal setback for the NFL in just a few days, after the Nevada Supreme Court ruled against the league on August 11 in former Las Vegas Raiders coach Jon Gruden’s arbitration case.
