In a major relief for Delhi Minister Kapil Mishra, the Rouse Avenue Court on Monday set aside a trial court’s order that had directed a further probe into his alleged role in the 2020 Delhi riots case.
The court allowed the petitions filed by Mishra and the Delhi Police challenging the earlier order of the Additional Chief Metropolitan Magistrate (ACMM), which had called for additional investigation into an alleged larger conspiracy behind the violence.
In April, the trial court had said that a cognisable offence was “prima facie" made out and required further investigation. It had also observed that Mishra was present in the area at the time of the alleged offence and directed police to conduct a deeper probe into his role.
The Rouse Avenue Court, however, overturned that directive, noting that the trial court’s order for further investigation was unwarranted in light of the existing findings in the case.
The 2020 Delhi riots, which erupted following clashes over the Citizenship Amendment Act, claimed more than 50 lives and left hundreds injured. Mishra, who has consistently denied any involvement, had earlier called the allegations against him “politically motivated."
