The Election Commission of India (ECI) informed the Supreme Court on Thursday (August 21, 2025) that its public notices have expressly mentioned that copies of Aadhaar cards can be submitted along with their claims by voters aggrieved by non-inclusion in the draft Bihar electoral roll.

The Supreme Court, in its interim order on August 14, 2025, directed the Election Commission of India (ECI) to make public a searchable list of over 65 lakh voter names deleted from the draft electoral roll, after the Special Intensive Revision (SIR) exercise, and give the reason for deletion.

The August 14 order was also the first time the Court had formally directed the use of Aadhaar as proof of identity and residence in the Bihar SIR exercise.

    Petitioner quotes The Hindu report

Petitioner Association for Democratic Reforms quotes The Hindu report in their written submissions to the SC:

“That the most critical category among those facing disenfranchisement are married women, temporary migrants, senior citizens and people with disabilities. As per a report from The Hindu, disproportionately higher number of women have been deleted from the electoral rolls putting into question the equity of the exercise.

As per The Hindu’s analysis for 9 Assembly Constituencies, for the younger 18-39 years age group, more than twice as many women than men have been deleted for the reason ‘Permanently Migrated.’ Overall, for every three men deleted for ‘permanent migration’, five women have been deleted. This defied any explanation.

As per Census 2011, the number of Men permanently migrating out of Bihar exceeds the number of Women migrating out. As for marriage, as per the Census of India 2011, as many as 95% of marriage-migrations take place within the state. This inequitable deletion calls to question the entire process of preparation of Draft Roll”.
