Gujarat HC Grants Six-Month Bail On Medical Grounds To Self-Styled Godman Asaram

Gujarat High Court granted Asaram six-month bail for medical treatment in the 2013 rape case, following a similar Rajasthan High Court order.

The Gujarat High Court granted six-month bail on Thursday to self-styled godman Asaram, who is serving a life sentence for a rape case from 2013. Justices Ilesh Vora and RT Vachhani provided 84-year-old Asaram temporary bail for medical treatment. A week ago the Rajasthan High Court passed a similar order.

The court orally stated it was granting bail on the same grounds as the Rajasthan High Court. Asaram’s lawyer presented the Rajasthan HC’s order to the bench, requesting bail due to his medical condition.

The state’s counsel opposed the plea, arguing that the medical facilities unavailable to Asaram in Jodhpur jail could be provided at Sabarmati central jail in Ahmedabad.

On October 29, the Rajasthan High Court granted Asaram six months’ bail after his lawyer argued he has been suffering from prolonged illness and that proper treatment is not possible in jail.

A bench of Acting Chief Justice Sanjeev Prakash Sharma and Justice Sangeeta Sharma passed the order while hearing his plea for suspension of the sentence and a regular bail.

In January 2023, a Gandhinagar court sentenced Asaram to life imprisonment for raping a woman disciple from Surat multiple times between 2001 and 2006 at his ashram in Motera near Ahmedabad. He is also serving a life sentence for raping a minor girl at his ashram in Rajasthan in 2013.

Asaram was convicted under Indian Penal Code sections 376 2 (C) (rape), 377 (unnatural offences), 342 (wrongful detention), 354 (assault or criminal force with intent to outrage a woman’s modesty), 357 (assault), and 506 (criminal intimidation).
