Panaji: The high court granted bail to an NDPS accused, Ibrahim Badusha from Kerala, who was arrested in 2023 in connection with the alleged trafficking of charas by transferring funds to another accused.Advocate Sana Raees Khan, representing Badusha, argued that the voluntary statements by the other three accused in the case, as well as Badusha’s voluntary statement under Section 67 of NDPS, are not admissible as evidence against him.The high court held that the statement of one of the other accused under Section 67, which implicated Badusha as allegedly being the financer and supplier of contraband, is inadmissible as evidence, and its contents cannot be considered for the purpose of deciding his bail application.The HC observed that the search conducted by NCB at Badusha’s residence revealed no incriminating material.The high court stated that merely because there were calls made by Badusha to the other accused at this stage doesn’t establish his direct involvement.
