The Government of India has introduced a fresh set of amendments to its citizenship framework, signalling a shift towards a more digitised and structured system for Overseas Citizen of India (OCI) cardholders.
The new rules aim to streamline procedures, reduce paperwork, and bring greater clarity to processes such as registration, renunciation, and cancellation of OCI status. They also formally codify certain provisions that were earlier followed in practice but not explicitly written into the rules.
The changes reflect the government’s broader push towards digital governance, with most processes now routed through online platforms and supported by electronic record-keeping. At the same time, the amendments introduce clearer safeguards and procedural transparency, particularly in areas such as appeals and documentation. Together, these updates are expected to simplify interactions for applicants while strengthening administrative oversight of OCI registrations.
Shift To A Digital OCI System
One of the key changes is the move towards a more streamlined digital system. Earlier, OCI processes involved a mix of online and physical submissions, including paperwork and duplicate filing requirements.
The Ministry of Home Affairs said in its notification that applications will now be handled entirely online, noting that “an application for registration as an Overseas Citizen of India cardholder… shall be made… electronically on the designated online portal," and adding that registrations may be issued either as a physical card or as an electronic OCI (e-OCI), with records maintained in electronic form.
Clear Rule On Minors Holding Passports
The amended rules explicitly clarify a provision relating to minors that was earlier understood in practice but not clearly codified in the rules.
The notification states that “the applicant… shall note that the minor child cannot at any time hold the passport of any other country while also holding an Indian passport," formally embedding this restriction within the Citizenship Rules.
Renunciation And Cancellation Now Digitised
The process for surrendering OCI status has also been moved online, replacing earlier manual procedures.
According to the notification, “a declaration of renunciation… shall be made… electronically on the designated online portal," and where a physical OCI card has been issued, it must be surrendered to the concerned authority. The notification further provides that an acknowledgement will be issued electronically and the individual’s name removed from official records, while also clarifying that cancelled cards must be returned or will be treated as cancelled.
Clearer Review And Appeal Mechanism
While provisions for review existed earlier, the amended rules define the process more clearly and assign responsibility to higher authorities.
The notification states that “the application shall be disposed of by an authority one rank higher," and that such decisions will be taken after giving the affected individual a reasonable opportunity to present their case, ensuring a more structured review mechanism.
Biometric Data Linked To Fast-Track Immigration
A new provision introduces the use of biometric data collected during OCI registration for future immigration facilitation.
Applicants are required to provide consent allowing their biometric data to be used for “registration under the Fast Track Immigration Programme… or for automatic registration" under such programmes in the future.
Removal Of Outdated Provisions
The amendment also removes older procedural requirements, including the need to submit applications “in duplicate," reflecting a shift towards a simplified and digital-first system.
