Pay Rs 30,000 As Monthly Maintenance To 4th Wife Or Face Action: HC Tells SP MP

Allahabad High Court orders Mohibbullah Nadvi to pay monthly maintenance to his fourth wife and refers the case to mediation, warning of legal action if he fails to comply.

The Allahabad High Court has ordered Samajwadi Party MP from Rampur, Mohibbullah Nadvi, to ensure regular payment of monthly maintenance to his fourth wife, cautioning that failure to comply could result in legal action.

Justice Subhash Chandra Sharma also directed that the case be referred to the High Court’s mediation centre in an effort to find an amicable resolution to the ongoing matrimonial dispute.

The court granted a three-month period for the parties to reach a settlement and ordered Nadvi to deposit Rs 55,000, from which Rs 30,000 per month is to be disbursed to his wife as maintenance, news agency PTI reported.

The directive came while hearing Nadvi’s petition challenging an April 1, 2024, order issued by the Additional Principal Judge of a family court in Agra.

During proceedings, Nadvi’s counsel informed the bench that the MP was willing to resolve the matter through mutual understanding.

Accepting the submission, the court noted, “The court is also satisfied on the basis of the record and the submissions made before it that the nature of litigation is such that there is a chance to resolve the matter through the process of mediation and an attempt ought to be made to explore that possibility."

However, in its September 11 order, the High Court made it clear that if Nadvi fails to deposit the specified amount, does not pay the ongoing maintenance, or if mediation proves unsuccessful, the interim order will automatically come to an end.
