The Supreme Court has agreed to hear Congress leader Meenakshi Natarajan’s petition challenging the rejection of her nomination for the Rajya Sabha elections from Madhya Pradesh, but has not granted any interim relief or stay on the election process.
The matter was mentioned before a vacation bench by senior advocate Abhishek Manu Singhvi, who sought an urgent hearing and requested that the declaration of election results be stayed. However, the court did not pass any order halting the poll process and agreed to list the matter for hearing after procedural requirements are completed.
Natarajan’s nomination was rejected by the Returning Officer during scrutiny after objections were raised alleging that she failed to disclose details of a case pending in Telangana in her election affidavit. The Returning Officer held that the affidavit was incomplete and contained omissions regarding the matter.
The Congress has strongly contested the decision, arguing that no criminal case is pending against Natarajan and that the alleged Telangana matter has not reached a stage where disclosure was required. Party leaders have termed the rejection unlawful and politically motivated.
A Congress delegation had earlier approached the Election Commission seeking reversal of the Returning Officer’s decision, contending that the poll body has, in previous instances, intervened in similar cases.
The rejection of Natarajan’s nomination significantly altered the arithmetic of the Rajya Sabha contest in Madhya Pradesh, where elections are scheduled for June 18. The development has improved the BJP’s prospects in the race for the state’s three Upper House seats.
The Supreme Court’s hearing is expected to determine whether the Returning Officer’s decision was legally sustainable and whether Natarajan’s candidature can be restored before the election process concludes.
