Karnataka had challenged the bail granted to Darshan and others in the Supreme Court.
The Supreme Court on Thursday cancelled Kannada actor Darshan Thoogudeepa’s bail in the Renukaswamy murder case, setting aside a Karnataka High Court order.
Justice Mahadevan, who was hearing the case along with Justice JB Pardiwala, observed: “We considered the grant of bail as well as cancellation, and it is evident that the high court order reflects mechanical exercise of power… The grant of bail will impact the trial, and the witnesses can be influenced."
The bench added: “The day we come to know that the accused is provided a five-star treatment, the first step would be to suspend the jail superintendent."
Darshan, actress Pavithra Gowda and several others, are accused of abducting and torturing 33-year-old Renukaswamy, a fan who allegedly sent obscene messages to Pavithra. According to the police, the victim was held in a shed in Bengaluru for three days in June 2024 and tortured. His body was later recovered from a drain.
The Karnataka government had submitted a written argument to the Supreme Court to cancel the bail of Darshan and other accused, highlighting several key points to prove the actor’s alleged involvement and arguing that the high court’s decision to grant bail was flawed.
The state’s case included forensic evidence, such as soil samples on the accused’s footwear matching the crime scene and Renukaswamy’s blood on their clothes.
It also alleged direct involvement by Darshan and Pavithra Gowda and claimed that the high court’s finding about the non-lethal nature of the weapons was incorrect.
Furthermore, the submission pointed to Darshan’s questionable conduct, such as attending a film premiere after claiming back pain for a court exemption. It also accused the high court of conducting an inappropriate “mini-trial" by dismissing crucial evidence during the bail hearing.
