Cardi B might’ve celebrated her courtroom victory a little too soon. The rapper, who was cleared last month in the lawsuit filed by her former security guard Emani Ellis, is right back in legal headlines.

Ellis has now filed a motion for a new trial, claiming the first one was a total mess from threats and intimidation to, believe it or not, Cardi allegedly throwing a pen outside the courthouse. To rewind a bit, Emani Ellis, a former security guard, had sued Cardi B over a 2018 incident, accusing her of assault and defamation after an alleged altercation while the rapper was pregnant. The case finally went to trial in Los Angeles in October 2025, ending with the jury ruling in Cardi’s favor.

Emani Ellis pushes for a new trial after losing Cardi B lawsuit

On October 31, 2025, Ellis’s legal team reportedly filed a motion for a new trial, claiming the verdict was unfair and influenced by misconduct. According to several court-tracking pages and entertainment law blogs, the filing argues that “serious irregularities” took place during the trial enough to warrant another chance in court.

The motion reportedly includes some pretty wild claims. Ellis’s lawyer alleges that Cardi’s attorney threatened and assaulted her legal counsel during the case, that Cardi threw a pen outside the courthouse, and that there were hidden witnesses and judge errors that tainted the verdict.

A hearing on the motion is said to be set for December 5, 2025, where a judge will decide whether there’s enough evidence to reopen the case. So far, Cardi B’s legal team hasn’t made any public comment on the motion or its claims. While the filing itself appears legitimate (dated Oct 31), not all the dramatic allegations have been confirmed by official court records. The viral posts circulating online reference portions of the motion, but the full document hasn’t been released publicly. If the court agrees to hear Ellis’s arguments, the case could briefly reopen. But if the motion is denied, Cardi B’s clean win stands and the saga finally ends there. For now, it’s Cardi B 1, Ellis 0 but Emani Ellis clearly isn’t backing down. Whether these explosive new claims hold water will be known on December 5, when the court decides if the rapper’s legal battle is truly over… or just getting started.
