A Delhi court on Tuesday granted bail to conman Sukesh Chandrasekhar in the money laundering case linked to the alleged bribery attempt to secure the AIADMK’s ‘two-leaves’ election symbol.
The bail was granted by the Rouse Avenue Court, which ordered Chandrasekhar’s release on a personal bond of Rs 5 lakh.
The court underscored that personal liberty is a fundamental constitutional right and cannot be curtailed without adequate justification, even in cases involving economic offences.
While acknowledging that money laundering is a serious crime, the court held that the law cannot be invoked to justify prolonged incarceration in the absence of compelling reasons.
It observed that courts cannot espouse the principle of liberty while simultaneously aligning with the State to deny bail solely on the grounds of special legislation or the gravity of economic offences.
The court further noted that although offences under anti-money laundering laws are grave, such special statutes cannot be used as a tool to erode the liberty of an accused through judicial process.
It clarified that the mere invocation of stringent laws does not automatically warrant continued detention.
Addressing the prosecution’s argument regarding Chandrasekhar’s criminal antecedents, the court said that the existence of as many as 31 cases against him, including the present one, does not negate his right to bail in this specific matter.
The court pointed out that Chandrasekhar has already spent more than half of the maximum prescribed period of imprisonment under the relevant provision, crossing the threshold that weighs in favour of bail.
However, the order will not result in Chandrasekhar’s immediate release from prison, as he continues to remain in judicial custody in connection with other cases. Of the 31 cases registered against him, he has already secured bail in 26 matters.
