Delhi and Bombay HCs, over mere weeks, granted a number of sweeping judgments – ex parte ad-interim injunctions – protecting ‘personality rights’ of several actors. All these orders mirror each other, obfuscating the exact ‘cause of action’ that merited the injunction.
An ex parte ad interim injunction is a discretionary remedy meant to be granted in exceptional circumstances, without hearing the other side, to safeguard rights of a party that might suffer irreparable harm without the remedy.
