In a recent address in Mauritius, CJI Gavai reflected on what he described as one of his tenure’s defining judgments – the ‘bulldozer case’. He remarked that it reaffirmed that India is governed by
rule of law
, not by force of executive power. It was a timely reminder. In a constitutional democracy law must always temper authority.
