RaoJaswantSinghGurgaon: The Haryana Real Estate Regulatory Authority (HRera) has directed realtor Vatika Ltd to pay Rs 62.4 lakh in compensation to a homebuyer couple for failing to deliver a residential plot within the stipulated timeline, as per an order issued on April 7, 2026.Allotees Vinay Kumar and Shalini Kumari booked a residential plot measuring 240 square yards in the developer’s project ‘Vatika India Next’ located in Sector 85 in 2010. The total consideration value of the unit was recorded at Rs 62.7 lakh, with possession contractually promised by July 27, 2013.The authority found that the allotted unit was not part of the approved layout, and no development had taken place at the site even after a decade.

The adjudicating officer further relied on findings placed on record, including a site assessment, which indicated that the specific allotted plot was not available in the approved layout plan.Based on these findings, HRera held that the developer had failed to fulfil its obligations under the agreement for sale. The authority also recorded that the option of offering an alternative unit could not be implemented in the present case.

Allowing the buyers to withdraw, HRera granted compensation, including the amount paid, along with Rs 2 lakh for mental agony and litigation costs. The order also mandates 10.8% interest until payment is realisedThe authority clarified that the relief granted is strictly in accordance with the statutory framework governing delayed possession and non-compliance by promoters under Rera.\The present order underscores the regulatory mandate of HRera in adjudicating disputes between homebuyers and developers, particularly in cases involving delay in possession and deviations from approved project plans.Despite repeated attempts, the spokesperson for the realtor did not reply to TOI’s request for a comment on the order.
