The Allahabad High Court on Friday pulled up the Uttar Pradesh police, saying its officers were routinely pressuring judges, particularly chief judicial magistrates (CJMs), to pass favourable orders.
During the proceedings, Justice Arun Kumar Singh Deshwal said the court could not allow UP to turn into a police state. Addressing the state counsel, he remarked, “Dekhiye isko na police State nai banane dena (See, we can’t allow this to become a police state)."
The remarks were made during a virtual hearing attended by DGP Rajiv Krishna and Additional Chief Secretary (Home) Sanjay Prasad, who were asked to explain steps to curb the rising trend of police shooting accused in the legs, Bar and Bench reported.
The court further noted a worrying trend of police, especially younger officers, pressuring judicial officers to secure specific orders across the state.
“Each and every district, law is not being followed. I have not come across a single case where law or direction of the apex court has been followed," Justice Deshwal said. He added that disagreements between district police chiefs and judicial officers had become routine whenever judges questioned police actions.
The court stressed that such disputes often escalated into direct pressure being exerted by superintendents of police on judicial officers for particular orders. In one instance, the judge revealed, a CJM had to be transferred “just to stop this tussle".
Justice Deshwal clarified that the issue was not limited to one district. Feedback from district judges indicated that in most districts, police officers, including IPS officers, were pressurising judicial officers if orders did not go their way.
The court also said it had received inputs from bar association leaders that senior police officers sometimes entered courtrooms to influence judicial proceedings.
Stressing the need for mutual respect, the court warned that such conduct would ultimately harm ordinary citizens. It added that police officers must not see themselves as superior to judges.
