Delhi High Court Summons Priya Sachdev Kapur In Rani Kapur’s Suit Over Family Trust Dispute

The Delhi High Court has issued summons to Priya Sachdev Kapur and others in Rani Kapur’s suit alleging that a family Trust was fraudulently created to strip her of her estate.

The Delhi High Court on Thursday issued summons to Priya Sachdev Kapur in a fresh civil suit filed by Rani Kapur, mother of late industrialist Sunjay Kapur, and also issued notice on her application seeking interim relief in the matter.

The suit alleges that a family Trust was created through fraudulent means to deprive the elderly widow of her estate.

According to Live Law, Justice Mini Pushkarna directed all defendants to file their written statements within thirty days.

On the plea for interim protection, the court said, “Let replies be filed within four weeks. Rejoinder, if any, be filed within two weeks."

Senior advocate Akhil Sibal appeared for Priya Kapur.

When Rani Kapur’s counsel referred to the interim relief application, the court remarked, “I am issuing summons. For interim, I will ask them to file replies. The Trust has not been created only now."

The matter has been listed for further hearing on March 23.

SUNJAY KAPUR CASE AND ALLEGATIONS OVER FAMILY TRUST

According to the suit placed before the court, Rani Kapur has challenged the legality of what is described as the “RK Family Trust" or “Rani Kapur Family Trust," calling it fraudulent, null and void.

She has alleged that her entire estate and family legacy were unlawfully diverted into the Trust without her knowledge or consent and that she became aware of the alleged fraud only after her son’s death on June 12, 2025.

The suit has named 23 defendants, including Priya Kapur, her son Azarias Kapur, Karisma Kapoor’s children Samaira Kapur and Kiaan Kapur; Rani Kapur’s daughter Mandhira Kapur Smith, and her two children.

Rani Kapur has also asserted that she is the sole beneficiary and legatee of her late husband, Dr Surinder Kapur’s estate.

Surinder Kapur, promoter of the Sona Group of Companies, died in June 2015, leaving behind a Will dated February 6, 2013, under which his entire estate devolved upon her.

The Will, the suit states, was probated by the Bombay High Court in January 2016 after their three children gave no-objection certificates.

Despite this, the plaintiff alleges that her assets were siphoned off through a “complex web of illegal transactions" and placed into the RK Family Trust, purportedly created around October 2017, without her consent.

She has further claimed that immediately after Sunjay Kapur’s demise, Priya Kapur moved swiftly to assume control of key Sona Group companies, securing appointments as director and managing director within days of the funeral rites, without informing or consulting her.

Another allegation is that her access to company information was blocked by falsely claiming that her email account had been “hacked," after which a new email ID was created and used without her knowledge to effect changes in Trust arrangements and company management.

Rani Kapur has sought restoration of her estate to the position that existed prior to the creation of the impugned Trust, terming it “illegal, fraudulent and unregistered."

RANI KAPUR’S ALLEGATIONS ON DOCUMENTS AND CONSENT

Rani Kapur has also raised concerns about the manner in which the RK Family Trust was created and operated, alleging that she was excluded from beneficial ownership of assets that originally belonged to her.

She has stated that the relevant events occurred when she was medically unwell after suffering a stroke and was dependent on her son to manage her personal and financial affairs.

According to the suit, she relied on assurances that her estate remained secure even as transactions were allegedly carried out that later deprived her of ownership rights.

She has further claimed that her late son was either manipulated into participating in the arrangement or allowed himself to be used as a channel for executing it.

Rani Kapur has alleged she was asked to sign documents without being informed of their contents or legal implications, and on some occasions, even blank papers.

These acts, she claims, were carried out in coordination with Priya Kapur and other defendants, who allegedly concealed the true nature and effect of the RK Family Trust.

She has also stated that she was led to believe that the Trust was merely a renamed or modified version of an earlier arrangement under which she remained the sole beneficiary, and that she realised only after her son’s death that the Trust allegedly excluded her and diverted benefits to other family members.
