The Delhi High Court on Tuesday urged the parties involved in the bitter legal battle over late businessman Sunjay Kapur’s estate to consider resolving their dispute through mediation, observing that “a lot of dirty linen was being washed in the open," Bar and Bench reported.

According to Bar and Bench, Justice Mini Pushkarna said the case reflected a “sorry state of affairs" and noted that while all parties had suffered a personal loss, they had also been blessed with significant financial wealth.

“God has blessed them with significant financial wealth, which should be enjoyed by everyone in a good manner. This blessing should not be turned into a curse," the court observed, as reported by Bar and Bench.

Sunjay Kapur’s estate is at the centre of multiple proceedings before the High Court. His third wife, Priya Sachdev Kapur, has claimed that Kapur left his entire personal estate to her through a 2025 will that she has produced. However, his former wife Karisma Kapoor, acting through their two children, has challenged the will as forged. Kapur’s mother, Rani Kapur, has also questioned the authenticity of the will and Priya Kapur’s control over the estate, filing a suit seeking to declare the family trust illegal, Bar and Bench reported.

During the hearing, the court emphasised the emotional toll on the family, particularly on Rani Kapur. “Ultimately, all the parties are suffering, and she [Rani Kapur] is already so old. No one should see a person’s son or daughter being demised when they are still alive. She has suffered a lot. You [Priya Kapur] are also suffering," Justice Pushkarna remarked, according to Bar and Bench.

Addressing Senior Advocate Akhil Sibal, who appeared for Priya Kapur, the court said it expected a more proactive approach from his client. “Mr Sibal, this court expects that you will take a more proactive approach in this. Since you are at the helm of the affairs, you can make this happen," the judge said, as per Bar and Bench. The court also stressed that Priya Kapur and her children must be taken care of, noting that she is now alone.

The observations were made while the court was considering Rani Kapur’s suit seeking cancellation of the family trust, valued at several thousand crores, and her plea to restrain the release of an interim dividend of around ₹28 crore to Priya Kapur. The bench also heard an application filed by Priya Kapur seeking rejection of her mother-in-law’s suit. Notices were issued in both matters, Bar and Bench reported.

Before parting with the case, the court again urged the parties to explore an amicable settlement through mediation, directing counsel to seek instructions from their clients. The matter is listed for further hearing on March 23. Senior Advocate Vaibhav Gaggar appeared for Rani Kapur.
