Here’s why Elon Musk’s Twitter is suing New York
The lawsuit filed by X against New York, targets a state law which asks the social media companies to create and maintain a clear policy on how they moderate content and to provide a mechanism for users to report hateful conduct. Furthermore, it obligates platforms to explain their content moderation decisions to users who report such conduct.X's legal complaint asserts that this state legislation forces private companies to adopt specific viewpoints on content, thereby compelling speech and interfering with the platform's editorial discretion. The company contends that this governmental interference violates the First Amendment, which protects freedom of speech, by dictating how X must manage user-generated content. The lawsuit also notes that the New York law closely mirrors a California statute that was partially blocked by a federal appeals court last year on similar free speech grounds.New York Attorney General Letitia James is named as the defendant in the case. Her office has not yet responded to the lawsuit.
