Ethan Klein breaks silence after losing copyright lawsuit against Denims, confirms appeal

Ethan Klein has spoken out after a U.S. court ruled against him in his copyright lawsuit involving Twitch streamer Denims. The H3 Podcast host shared his reaction on Instagram after court papers confirmed that Denims had won the case.

Even though the decision did not go in his favor, Klein made it clear that he does not plan to stop fighting. He said he strongly disagrees with the ruling and has already started the appeal process, hoping a higher court will look at the case again.

The legal fight started last year when Ethan Klein filed a copyright lawsuit against Twitch streamer Denims. He also included streamers Morgan "Frogan" and Kacey "Kaceytron" in the case.

Klein claimed that the creators used his YouTube video, Content Nuke - Hasan Piker, during their livestreams without permission. According to him, they reacted to the video in a way that broke copyright rules and took viewers away from his original content.On July 1, 2026, court documents showed that the judge ruled in Denims' favor. The judge decided that her use of Klein's video was protected under "fair use," which is a rule in copyright law that allows people to use copyrighted content in some situations, such as for commentary, criticism, or reaction.

The judge explained that three of the four fair use factors supported Denims' defense. The ruling also granted Denims' Motion for Judgment on the Pleadings, ending this stage of the case in her favor.Soon after the court documents became public, Klein posted an Instagram Story to respond. He confirmed that he had lost this part of the case but also said he would continue the legal fight through an appeal.

In his Instagram Story, Ethan Klein explained why he disagrees with the court's decision.He argued that the ruling could allow people to react to someone else's video almost immediately after it is released and still be protected by fair use, even if they watch most or all of the original content while adding only occasional comments.Klein also said he believes the decision does not match another copyright ruling involving H3 snark moderators that was made in the same court district.Because of this, he said he is "extremely confident" that a higher court will overturn the decision. He confirmed that the appeal process has already begun.An appeal does not mean the first decision has changed. Instead, it means a higher court will review the case and decide whether the original ruling should stay the same or be changed.For now, Denims has won this stage of the copyright lawsuit after the court accepted her fair use defense. However, Ethan Klein says the legal battle is not over. With an appeal already underway, both creators could be waiting for another court decision that may shape how similar copyright and reaction content cases are handled in the future.
