When Vishnu Tiwari walked out of jail in 2021, freedom did not feel like a victory. He had spent two decades behind bars for a crime he did not commit, and during those years, life outside had completely moved on without him. His parents were gone, his family had fallen apart, and the world he once knew no longer existed.

Now, a video is being circulated widely that shows a man breaking down in tears as he walks out of prison. While News18 has not independently verified the authenticity of the clip, it is being widely linked to Vishnu, who was acquitted by the Allahabad High Court in 2021 after spending 20 years in jail in a false rape case.

A Case That Began In 2000

In September 2000, Vishnu, a resident of Lalitpur district in Uttar Pradesh, was arrested following allegations of rape and charges under the SC/ST (Prevention of Atrocities) Act. He was convicted by a trial court in 2003 and sentenced to life imprisonment in Agra Central Jail. He was 23 at the time. From that point on, he remained in jail without once being granted bail.

Over the next two decades, Vishnu never stepped outside prison walls, not even temporarily. He was not released on parole, including during the peak of the coronavirus pandemic, when several prisoners were freed to reduce overcrowding in jails. During this time, his parents and two brothers passed away, his family was socially ostracised, and the five acres of land they owned were sold. Reports from the time also stated that he was not allowed to attend the last rites of his family members.

Speaking at the time, he said, “I am happy, but I don’t know what to do now. My house is in ruins…My family members are dead. We are demanding cooperation from the administration. In my case, the investigating officer filed a false report. There was a dispute about tying a cow. My lawyer also ditched me."

The now-viral video (being linked to Vishnu) shows a man crying uncontrollably as he steps out of the jail. Several social media posts described how his life was completely crashed after spending years in prison.

What Are People Saying Online

The video has sparked intense reactions on social media with users expressing anger, grief and frustration over the years Vishnu spent in prison.

One user commented, “I hope the government compensates him heavily and jails the woman who wrongfully accused him of grape. She took 20 years of his life, so 20 years of hers should be spent in prison."

Another said, “And we are a democratic country. No words to say."

“Women who use rape for false cases are not hated enough," someone else remarked, while a person added, “It’s best not to mess with girls in India… I’m ashamed to say this, but it’s the reality."

“False accusations destroy everything. Judiciary must be unbiassed but here the Judiciary (cole sum) is the prima face of all western ideology, and they have no one to control, collude, include, silently exclud, ore do whatever they want. Hindus have been treated injustice for 1000 years," a viewer wrote.

“Shouldn’t such a false accuser be sent to jail for an equal amount of time? Much respect to Adv Shweta Singh Rana," an individual said.

Shweta Singh Rana: The Lawyer Who Aided Vishnu Tiwari

Vishnu’s appeal remained pending before the Allahabad High Court for nearly 16 years because it was marked as defective. Such defects usually involve missing documents or filing errors that need to be corrected by a lawyer before a case can be heard. In this instance, the appeal was never properly pursued, and the defects were not addressed.

In its judgment, the High Court also noted that the State government did not take steps to consider commuting his life sentence even after he completed 14 years in prison.

The case saw progress only in 2019, when legal aid lawyer Shweta Singh Rana was assigned to represent Tiwari after jail authorities approached the High Court. Preparing the paperbook (a complete set of records from the lower court) took almost two years.

After examining the case, a division bench comprising Justices Kaushal Jayendra Thaker and Gautam Chaudhary acquitted Vishnu Tiwari of all charges.
