A court in Gujarat has sentenced a school teacher to more than three years in jail for slapping a Class 9 student over unfinished homework, an assault that ruptured the girl’s eardrum and caused lasting hearing damage.

Additional Chief Judicial Magistrate Himanshu Choudhary, in a judgment delivered on January 30, said the offence was a clear abuse of authority by a teacher and had resulted in serious and long-term injury to a minor.

The court noted that the 14-year-old girl suffered a perforation of her left eardrum, leading to “longstanding hearing impairment" and ongoing medical issues.

The incident took place on January 1, 2020, at Baa Shri Vasantkuvarba School, a private school in Gandhinagar. According to the prosecution, the teacher, Parulben Patel, became angry when the student failed to complete her homework and slapped her three times on her left ear. The blows caused severe damage to the eardrum.

Following a complaint filed by the girl’s family, the Sector-21 police registered an FIR against the teacher two days after the incident. Medical evidence presented before the court confirmed the nature and seriousness of the injury. The court also observed that even four-and-a-half years after the assault, the victim was still undergoing treatment.

The court convicted Patel under Section 325 of the Indian Penal Code for voluntarily causing grievous hurt and Section 75 of the Juvenile Justice Act for assaulting a child. She was sentenced to three years and three months in prison and fined Rs 50,000. The fine amount has been directed to be paid to the victim as compensation.

In her defence, Patel claimed the student was indisciplined and that the case was falsely filed by the parents. Her lawyer also sought leniency, citing her alleged cancer ailment. However, the court rejected the plea, stating no documentary proof was submitted.

The court said granting probation would weaken child protection and fail to serve as a deterrent, stressing that the gravity of the offence outweighed any mitigating factors.

“Such factors outweigh mitigating circumstances. Grant of probation would defeat the object of deterrence and child protection. Moreover, no documentary evidence in support of the cancer ailment has been brought on record," it stated.
