A recent ruling by the Madhya Pradesh High Court has reignited debate around marriage, divorce and family disputes, after it upheld a family court’s order directing a DNA test in a long-running case involving an Army soldier and his wife. The decision came while hearing the wife’s petition challenging the test, which she argued was unwarranted.

Justice Vivek Jain dismissed the plea and made it clear that the direction for a DNA test was not intended to question the legitimacy or legal status of the child. Instead, the court emphasised that the purpose of the test was limited to examining the truthfulness of allegations made against the wife in the context of the ongoing divorce proceedings.

The court also addressed the issue of non-compliance. It observed that if the wife refuses to provide a DNA sample, the family court would be within its authority to draw an adverse inference against her under Section 114(h) of the Indian Evidence Act, as well as under the provisions of the Bharatiya Sakshya Adhiniyam, 2023. In effect, the court noted, refusal to cooperate would not work in her favour.

At the heart of the dispute is a claim that has significantly influenced the course of the case. The husband, an Army personnel, told the court that he had come home in October 2015 at his wife’s request.

According to him, just four days after he left, his wife informed him that she was pregnant. The High Court found this timeline medically questionable, noting that detecting a pregnancy within four days would be highly unusual. It also took into account that the child was born about eight months after October 2015, which, the husband claimed, indicated they had not been together for long enough to explain the pregnancy.

The matter is part of a prolonged legal battle spanning nearly a decade. The first divorce petition was filed in 2019 but later withdrawn after the couple initially agreed to separate. A second petition filed the same year did not move forward after the wife failed to appear for the second motion, leading to its closure on March 2, 2021. A third petition, filed in 2021 and still pending, includes the husband’s demand for a DNA test.

In its order, the High Court underscored that where allegations of adultery form the basis of a divorce case, and the husband has clearly stated that the child’s legitimacy and maintenance are not being contested, directing a DNA test cannot be termed legally improper.
