The Compassionate Appointment Scheme in India allows a dependent family member of a deceased government employee to secure employment if the employee dies while in service or retires on medical grounds.

However, in light of the shocking Jaipur murder case, where 23-year-old Ayushi Sharma allegedly hired contract killers to murder her widowed mother, Neeraj Sharma, to inherit her property and claim her clerical court job, the law is absolutely clear: a person accused of murdering the employee is legally barred from receiving a compassionate appointment.

Under the principle that a criminal cannot benefit from their own crime, the scheme is completely frozen or denied for anyone facing such criminal charges.

What is the Jaipur contract-killing case?

The Jaipur contract-killing case involves Ayushi Sharma, who allegedly hired hitmen to murder her 45-year-old widowed mother, Neeraj Sharma, to seize family property and claim a court job. According to the Jaipur East Police investigation led by DCP Ranjita Sharma, the plot was hatched over three months because Ayushi was furious that her mother had taken a clerk position following her father’s death instead of letting her have it.

Roughly a year prior, Ayushi’s father (Vijay Kumar Sharma), a Lower Division Clerk (LDC) at a Jaipur court, passed away. The mother, Neeraj Sharma, claimed the available government job on compassionate grounds, triggering a toxic, long-running domestic feud over employment and ancestral property.

Ayushi allegedly allied with her paternal uncle (Mohan Swaroop) and her cousin (Balram alias Ravi) to eliminate Neeraj. They orchestrated a ₹7 lakh contract killing scheme using hitmen from Bharatpur. The conspirators initially rented a Mahindra Thar to shadow Neeraj and run her over, but they failed to execute the plan.

On July 3, Neeraj was walking home after dropping her son off at a coaching center in the Pratap Nagar locality. A speeding Mahindra Scorpio SUV — travelling at roughly 130 km/h — deliberately struck her, throwing her body nearly 100 feet and killing her on the spot.

How the cover-up unravelled?

Initially, the police registered the incident as a standard hit-and-run traffic accident. However, Neeraj’s brother, Rakesh, suspected deep-rooted foul play given the family’s aggressive history over money and filed a comprehensive FIR.

When Jaipur Police thoroughly analysed localised CCTV footage, they caught the Scorpio tracking Neeraj’s exact movements for nearly a month, proving premeditation.

The arrests

A total of seven individuals have been arrested by the police so far:

  • Ayushi Sharma (The daughter and alleged mastermind)
  • Mohan Swaroop (Ayushi’s paternal uncle)
  • Hemant Sharma (The primary contract killer)
  • Mohit Sharma, Akash Sharma, Arvind Sharma, Rohit Jatav (Accomplices/hitmen team)
  • Ayushi’s cousin, Balram (alias Ravi), who actively assisted in planning the hit, remains at large as an absconding suspect.

What is the Compassionate Appointment Scheme?

The primary objective of the scheme is to provide immediate financial relief to a family thrown into sudden penury by the loss of its breadwinner:

Target Group: Appointing a dependent family member (spouse, son, daughter, or legally adopted child) of a government servant who dies while in active service.

Post Availability: Appointments are strictly limited to Group ‘C’ or Group ‘D’ posts (such as Lower Division Clerk, peon, or assistant roles).

The 5% Cap: These appointments cannot bypass standard vacancy rules; they are capped at a maximum of 5% of the total regular vacancies falling under the direct recruitment quota in any given year.

Financial Need: The family must be in a state of financial distress. If the family has substantial assets or alternative sources of steady income, the government can reject the application.

Time Limitation: The application for a compassionate post must be made within a reasonable timeframe (typically within a few years of the employee’s demise) to satisfy the “immediate relief" criteria.

How does the law handle criminal acts & disputes?

The Jaipur case highlights complex legal boundaries regarding who gets the job when a crime or dispute occurs within the family.

Disqualification via Murder: Under Indian jurisprudence (drawing parallels to Section 25 of the Hindu Succession Act), a person who commits murder or abets a murder to accelerate their succession or benefits is legally disqualified from inheriting those benefits. In Ayushi Sharma’s case, facing murder charges completely invalidates any claim to her father’s or mother’s government benefits.

Not an Absolute Right: The Supreme Court of India has consistently ruled that a compassionate appointment is not an alternative source of recruitment or a hereditary right. No family member can demand it as a matter of right.

One-Time Settlement: Once a dependent family member (such as the mother, Neeraj Sharma) accepts and joins the compassionate post, the scheme’s obligation is fulfilled. The job turns into standard public employment. If that appointed person dies later, the position cannot automatically be passed down to another child as a “inherited" compassionate job unless a brand-new dependency case of extreme penury is proven for the second time.

Family Disputes: If multiple dependents (e.g., a sibling and a spouse) fight over who gets the post, the government typically prioritises the spouse. If the spouse waives their right, they can nominate a child, provided all other eligible dependents sign a No Objection Certificate (NOC).
