 Court orders release of car after accident with Rs 8.30 crore surety

KANPUR: In the Kanpur Lamborghini case, the car was released from the Gwaltoli police station last night following a court order. The car was transported by truck. To recall, the court of Chief Judicial Magistrate Suraj Mishra on Friday ordered the release of a Lamborghini car worth crores that was parked at Gwaltoli police station since a road accident.

The court directed that a surety of Rs 8.30 crore and an undertaking had to be furnished for the car.On 7 February, Shivam Mishra, son of tobacco businessman KK Mishra and a resident of Arya Nagar, was travelling in the Lamborghini with his driver Mohan M. At the Bhairoghaat intersection, Taufiq Ahmad, a resident of Chamanganj Ghosiyana, was hit in the accident and was injured.After the incident, driver Mohan M surrendered in court. Police submitted a report stating that the driver was not accused in the case.

Later, police arrested Shivam Mishra for not cooperating in the investigation and not responding to the notice, and presented him in court. The court termed the arrest as wrong and did not take him into judicial custody. He was released on a personal bond of Rs 20,000.An application was filed in court on behalf of Shivam Mishra for the release of the car. An attorney in the name of Sunil Kumar was appointed on behalf of Shivam for pursuing the case. The court sought the technical examination report and the police report.

After both reports were received, the court accepted the release application.Advocate Shivakant said, "that in such cases, the court fixes a surety amount in exchange for releasing the vehicle. The amount of surety depends on the discretion of the court. However, usually the surety amount is determined equal to the value of the vehicle."
