Patna: Educator, Faisal Khan, popularly known as Khan Sir, received interim relief from a Patna court on Saturday in the coaching institute firing incident. The court extended its earlier “no coercive action” order, ensuring that Khan will not be arrested until the next hearing scheduled for June 25The order was passed by Sessions Judge Rupesh Deo while hearing Khan’s anticipatory bail petition.
According to the court order, the case diary sought by the court was received on Saturday and has been handed over to the public prosecutor in a sealed cover for examination. The prosecutor has been directed to return the diary by June 23, after which the matter will be taken up for further hearing on June 25.The court noted that Khan apprehends arrest in Kadamkuan police station case, registered under Section 109 of the Bharatiya Nyaya Sanhita (BNS) and Sections 25(9), 27 and 35 of the Arms Act.
Pending the next hearing, the protection from arrest granted earlier on June 9 has been extended. However, the court directed him to cooperate with the investigating officer and remain available whenever required by the police.Advocate Arvind Kumar Mawar, appearing on behalf of Khan, said the police submitted the case diary during the hearing and it was provided to the public prosecutor for preparation of arguments.
He stated that the matter has now been fixed for final hearing on June 25.Three staff members associated with Khan Sir’s institute have also been granted protection from coercive action until further orders from the court.Meanwhile, the bail petitions of Khan’s two security guards, Pradeep Kumar and Talebar Singh, were heard on Saturday. The court ordered that both guards will remain in judicial custody till June 25.
Their bail applications will also be heard on the same day, as the proceedings are linked to the main case.The case stems from the June 2 violence outside the Khan Sir’s institute campus in Kadamkuan area. Following clashes, vandalism and stone pelting, an FIR was registered after a video allegedly showed security personnel firing shots. Police subsequently named Khan in the case and launched an investigation into the circumstances surrounding the firing incident.
