Bhopal: The Madhya Pradesh High Court has upheld an eviction decree against a Gwalior tenant, ruling that once landlord-tenant relations are established, a tenant cannot seek a full inquiry into the landlord’s title in an eviction case.
Justice Ashish Shroti dismissed the second appeal by Suresh Chaturvedi and affirmed the lower courts’ findings ordering his eviction from a property at Shinde Ki Chhawani, Lashkar.The court said title issues are only incidental in proceedings under the MP Accommodation Control Act. Relying on a registered rent agreement, rent receipts and oral evidence, it held that Chaturvedi was inducted as a tenant in 1986. The bench also rejected the plea of adverse possession, saying a tenant’s possession remains permissive unless hostile possession is clearly proved.
