The National Investigation Agency (NIA) has informed the court that it is facing non-cooperation from the West Bengal Police, once again bringing the Central agency and the State police into direct confrontation.

The development has revived questions within political and bureaucratic circles in West Bengal about whether relations between Central and State law enforcement agencies are headed for another prolonged standoff.

In an application filed before the court, the Deputy Superintendent of Police and Chief Investigating Officer (CIO), NIA Kolkata, alleged that the Investigating Officer (IO) of Beldanga Police Station failed to hand over case materials and alams (seized articles) related to Beldanga Police Station Case No. 51 of 2026, dated 17 January 2026, despite clear and earlier judicial directions. The case has since been taken over by the NIA.

The NIA further submitted that the accused persons in the case were not produced before the court. The Superintendent of Berhampore Central Correctional Home submitted a non-production report for 31 undertrial prisoners, citing the unavailability of police escort as the reason.

The court recorded that the failure to provide police escort by the local police resulted in the non-production of the accused persons on the scheduled date.

Directions issued by the Court

Taking note of the allegations and the sequence of events, the court passed the following directions:

  • The Superintendent of Police, Murshidabad, has been directed to personally submit a detailed report addressing the allegations of non-cooperation raised by the NIA.
  • The Superintendent of Berhampore Central Correctional Home has been directed to ensure the production of the accused persons positively by 12 February 2026.
  • The Superintendent of Police, Murshidabad, has been directed to ensure adequate police escort for the production of the accused on the next date of hearing.
  • The Investigating Officer of Beldanga Police Station has been directed to appear personally before the court on the next date and explain, in writing, why the court’s order dated 30 January 2026 was not complied with.
  • The Officer-in-Charge of Beldanga Police Station has been directed to formally communicate the court’s order to the Investigating Officer for immediate compliance.

Next date of hearing

The court has fixed 12 February 2026 as the next date for:

  • Production of the accused persons
  • Personal appearance of the Investigating Officer, Beldanga Police Station
  • Submission of the report by the Superintendent of Police, Murshidabad

Relations between Central investigative agencies and the West Bengal Police have been strained over the past five years. This latest court proceeding adds to a growing list of instances highlighting institutional friction between State and Central law enforcement authorities.
