Remarks on Col Sofiya Qureshi: SC extends interim order against MP minister Kunwar Vijay Shah’s arrest

Sofiya QureshiOn May 12, Shah had said that India taught a lesson to those responsible for the Pahalgam terror attack using “their own sister”. While he did not name any individual, the Congress alleged he was alluding to Colonel Qureshi.

Noting that the Special Investigation Team (SIT) comprising three IPS officers has begun its probe into Madhya Pradesh minister Kunwar Vijay Shah’s alleged objectionable remarks on Colonel Sofiya Qureshi, who was part of the daily briefings during India’s military face-off with Pakistan, the Supreme Court on Wednesday extended the interim order against his arrest.

A bench of Justices Surya Kant and Dipankar Datta also asked the Madhya Pradesh High Court, which had taken suo motu cognisance in the matter, to close the proceedings given that the Supreme Court is seized of it now.

“In view of the fact that this court has taken cognisance of the matter, we request the High Court to close the proceedings…,” the bench said. “There is no need for parallel proceedings,” Justice Kant orally remarked.

Agreeing, Solicitor General Tushar Mehta said, “Once your lordships are monitoring, there cannot be high court monitoring.”

At the outset, Mehta informed the bench that the SIT has started the investigation. Submitting the SIT’s status report to the court, he said, “Since it is ongoing investigation, I would not put it in public domain.”

The bench said in its order, “A status report dated May 27, 2025 has been filed by DIG of police…inter alia pointing out that in pursuance to order dated May 19, 2025, SIT comprising 3 IPS officers has been constituted….The SIT visited the site and conducted spot investigation on May 21, 2025. Thereafter some more material has been collected. Script of the speech has also been prepared. One mobile phone etc have also been seized. And statements of 9 witnesses have so far been recorded. It is further pointed out that the investigation is still in initial stage. Some more time has been prayed for.”

Allowing the request, the bench posted the matter for hearing in the first week after it resumes normal working. The court is currently observing partial working days.

“The investigation shall continue and status report shall be filed on the date fixed,” the court said. It also refused to allow an intervention application in the matter, saying, “That day also we said, please do not politicise any matter.”

On May 12, Shah had said at an event in Mau that India taught a lesson to those responsible for the Pahalgam terror attack using “their own sister”. While he did not name any individual, the Congress alleged he was alluding to Colonel Qureshi.

Shah later sought to clarify the remarks, saying, “Do not see my speech in a different context. I want to tell people that my speech is not in that context. They are our sisters, and they have taken revenge with great strength along with the armed forces.”
