Avalahalli Police Under Fire After Family Alleges Torture in Infant Death Case

A family in Bengaluru has accused police officers from the Avalahalli Police Station of custodial torture after the death of an infant girl, alleging they were forced to confess to killing the child.

The allegations come after Bengaluru Police arrested the parents of the 11-month-old baby, claiming they murdered her and attempted to portray the death as an accident.

According to the family, police falsely implicated them in the case and subjected them to severe physical assault during the investigation.

What we know about the child’s death?

The incident took place on June 9 in Kitaganur village under the jurisdiction of Avalahalli Police Station in East Bengaluru.

The child’s father, Shekappa, initially told police that the baby had fallen from a bed after her mother, Vijayalakshmi, fell asleep while breastfeeding. The child was taken to East Point Hospital, where doctors declared her dead.

Based on his complaint, police registered an Unnatural Death Report (UDR) and began an inquiry.

The family said they had moved to Bengaluru from Yadgir for work and were living in Avalahalli with their son and infant daughter. They claimed the child fell from the cot onto stones and firewood kept underneath, causing fatal injuries.

Allegations against police

The family alleged that police later converted the case into a murder investigation after receiving the postmortem report.

They claimed Shekappa, Vijayalakshmi, Shekappa’s younger brother and a 19-year-old youth were stripped, tied up and assaulted to force them to confess to killing the child.

The family further alleged that chilli powder was thrown into the eyes of three people, green chilli paste was rubbed on their bodies, and a woman was assaulted after her clothes were pulled. They claimed two women police personnel and three male personnel were involved.

What police said?

According to the FIR filed by Avalahalli Police Sub-Inspector Sunil Kumar, the child had injuries on her face, chest, legs and private parts that were not consistent with a fall from a cot.

The FIR also referred to witness statements alleging that Vijayalakshmi was involved in an illicit relationship and that the couple often quarrelled. It further claimed she did not have much affection for the second child.

Police alleged that during an argument on the day of the incident, Vijayalakshmi kicked the child after calling her “a misfortune". The FIR further stated that while Shekappa was assaulting his wife, the child came between them and he picked her up and threw her.

The postmortem report concluded that the child died due to haemorrhage, respiratory failure and multiple internal organ injuries. Based on the report and witness statements, police registered a murder case against the parents.

Police deny coercion

Responding to the allegations, Whitefield Division DCP Saidulu Adavath denied that any coercion had been used during the investigation.

He said the crime scene had been examined, injuries were found on the child’s body and the investigation was based on the doctor’s postmortem report. He added that the father had been arrested and remanded to judicial custody, while the investigation into the mother’s role was continuing.

The DCP said action would be taken if any negligence by police personnel was found and maintained that the investigation was still in progress.
