A 34-year-old Texas man died outside a Houston steakhouse after restaurant staff allegedly mistook him for a homeless person and failed to call for medical help, according to his family. Jessie Mobley Jr. had reportedly fallen asleep after finishing a meal at KFFO Afro Steakhouse in the Eldridge/West Oaks area on August 7, the New York Post reported.

Instead of checking on him, employees allegedly assumed he was a passed-out vagrant and carried him outside, propping him up with his belongings in the restaurant’s parking lot. According to the Houston Police Department, Mobley was not discovered until the next morning.

Authorities confirmed that no one from the restaurant called 911. Mobley was found unresponsive around 9 am ET by a student from Behind the Chair Institute, a beauty school located next door, who noticed him while walking to class. First responders pronounced him dead at the scene.

Mobley had been living with his aunt, Charlene Fogg-Drake, who was devastated by the news. She told the Houston Chronicle she believes her nephew might still be alive if someone had called for help. “Why didn’t you call 911? I feel like people need to be accountable for it, I really do," she said.

Mobley’s parents, who have lost three children in the past 13 years, also expressed anger and heartbreak over the incident. “We just think if somebody had gotten him some help instead of putting him on the sidewalk — called 911 if nothing else. If you don’t know what’s wrong with someone, you shouldn’t assume," said his mother, Renee Mobley.

They also claimed that by the time they saw their son’s body, it had already begun to decay, and his skin had turned a dark colour. Mobley was cremated in Houston, and his ashes were taken back to Spring, Texas, about 25 miles north.

No cause of death has been officially determined, as authorities are still awaiting autopsy results. The owners of KFFO Afro Steakhouse declined to comment, according to KHOU.

Fogg-Drake said she has tried multiple times to create a small memorial near the parking lot with flowers and candles, but it has repeatedly been taken down. She had been planning a birthday dinner for Mobley at a waterfront restaurant, but he died just a week before turning 35.
