President Donald Trump moved a petition in the United States Supreme Court for a review of the lower court’s order that declared most of his tariffs “illegal", and asked the court to overturn the decision.

He filed the plea late on Wednesday (local time), seeking review of the federal appeals court ruling in Washington DC, The Guardian reported.

The court had ruled that Trump’s “liberation day" import duties that he announced on April 2 – which ranged between 10% and 50% on most US imports – were illegal.

In a 7-4 order last Friday, the federal appeals court ruled that Trump had overstepped his presidential powers in his invocation of a 1977 law, which is meant to address national emergencies.

This was the biggest blow to Trump for his tariff policies; however, the levies were allowed to be in place until October 14, thus offering time to the administration to move the Supreme Court against the order.

Trump has appealed to the Supreme Court, which is now expected to review the order. The judges must agree to hear the matter. The administration has asked the apex court to make a decision on this by September 10, The Guardian reported.

The government has appealed to the court for an accelerated schedule and for the arguments to be heard by November 10, according to Bloomberg. The judges could deliver their verdict by the end of 2025.

The appeals court’s decision on tariffs had upheld a previous order by the US Court of International Trade.

The federal appeals court said that US law “bestows significant authority on the president to undertake a number of actions in response to a declared national emergency, but none of these actions explicitly include the power to impose tariffs, duties, or the like, or the power to tax".
