A domestic dispute from Bengaluru, which escalated into a criminal case, recently came under scrutiny before the Karnataka High Court, with the court stepping in to temporarily halt the investigation. The case drew attention after a husband sought judicial intervention to quash a police complaint filed by his wife, arguing that the allegations were trivial and legally unsustainable.
According to court records, the woman had approached the police alleging cruelty after her husband refused to bring certain household items, including body lotion meant for their child. Based on her complaint, a criminal case was registered at the Srirampura Police Station under provisions related to cruelty and assault.
Following this, the husband filed a criminal petition before the High Court seeking to quash the case as well as the proceedings initiated before a Bengaluru magistrate court. He contended that the complaint was filed with malicious intent and lacked substantive grounds to attract criminal charges.
Husband’s Arguments Before the Court
During the hearing, the counsel appearing for the husband argued that the complaint was lodged only after the husband-initiated divorce proceedings. It was submitted that the timing of the police complaint raised serious doubts about its intent.
The petitioner also contended that the allegations in the complaint were vague, inconsistent, and did not disclose any offence serious enough to warrant criminal prosecution. It was further argued that the statements recorded from witnesses were false and appeared to be tailored to strengthen the complaint without factual backing.
Court’s Interim Order
After hearing the submissions, the High Court issued an interim stay on the investigation and further proceedings in the case. The bench noted that the matter required closer examination and adjourned the case for a later hearing.
The stay order means that, for now, the police cannot proceed with the investigation until the court hears the matter in detail and decides whether the criminal case should be quashed entirely.
What the Petition Says
In his petition, the husband stated that the dispute arose when his wife called him asking him to bring milk and body lotion for the child. He claimed he refused, stating that he did not wish to spend money unnecessarily. According to him, this refusal alone led to the filing of a police complaint alleging domestic cruelty.
Legal observers say the case highlights the increasing number of domestic disputes reaching criminal courts and the judiciary’s role in examining whether such complaints meet the legal threshold for prosecution. The High Court’s interim order underscores that not all marital disputes automatically translate into criminal liability and must be assessed on their merits.
The matter is expected to come up for further hearing in the coming weeks, when the court will decide whether the case should be quashed permanently.
