The Supreme Court on Monday granted bail to three individuals accused of conspiring to swap blood samples in the high-profile 2024 Pune Porsche crash case. The bench, comprising Justices BV Nagarathna and Ujjal Bhuyan, ordered the release of Aditya Avinash Sood, Ashish Satish Mittal, and Amar Santhosh Gaikwad, primarily citing their prolonged incarceration of over eighteen months without the commencement of a trial.

The Conspiracy and Allegations

The case stems from the fatal accident on May 19, 2024, in which a speeding luxury car allegedly driven by an inebriated 17-year-old killed two young IT professionals, Aneesh Awadhiya and Ashwini Koshta, in Pune’s Kalyani Nagar. The subsequent investigation unravelled a sophisticated cover-up involving the swapping of blood samples at the state-run Sassoon General Hospital to conceal the presence of alcohol.

The three men granted bail played specific roles in this alleged tampering:

Aditya Sood: The father of one of the minor passengers, accused of providing his own blood sample to replace that of his son.

Ashish Mittal: A friend of the father of another minor occupant, alleged to have swapped his blood sample with that of the minor.

Amar Gaikwad: An alleged middleman who reportedly facilitated the transaction and handed over a bribe of Rs 3 lakh to hospital staff.

Judicial Observations on Parenting

While granting relief, the apex court clarified that the decision was based on the principle of “liberty versus incarceration" and the fact that there are over 150 witnesses yet to be examined. However, Justice Nagarathna voiced stinging criticism regarding the “disturbing pattern" of parental irresponsibility.

“Celebration is not on the basis of substance abuse and driving at speed," the bench observed. “The main ones responsible are the parents who provide sufficient funds for a gala time… giving them an ATM card and a mobile phone because they have no time to spend with their children."

The court warned the accused against contacting any witnesses or attempting to influence the trial, noting that any violation would lead to the immediate cancellation of their bail. The state government had strongly opposed the plea, arguing that the accused had used “money power and superiority dominance" to subvert the criminal justice system.
