The Supreme Court slammed a married woman for engaging in a sexual relationship outside of her marriage and suggested she may face prosecution.

The Supreme Court on Wednesday slammed a married woman for having sex outside of her marriage and accused her lover of not marrying her after promising to do so. The court also told the woman she may be liable for prosecution for the same.
According to a report with The Times Of India, the court’s remark came after the woman approached the court and sought the cancellation of bail granted to her lover, who, as she alleged, engaged with her in sexual activities on the pretext of marriage.
The court warned the woman that she may be liable for prosecution for indulging in physical acts with a man other than her husband during the subsistence of her marriage.
“You are a married woman with two children. You are a mature person, and you understand the relationship you were getting into outside the marriage," a bench of Justices MM Sundresh and N Kotiswar Singh told her, as her counsel argued that the man had continued to engage in a sexual relationship with his client on the false promise of marriage.
Her counsel further alleged that his client, on multiple occasions, was called to various hotels by the man for sex, as he promised her marriage.
“Why did you go to the hotels repeatedly at his beckoning?" the bench asked the woman.
“You very well understand that you also have committed an offence by having a sexual relationship outside the marriage," it said, adding, the Patna High Court was right in granting anticipatory bail to Ankit Barnwal and dismissing the plea of the woman.
Earlier, a trial court had refused the anticipatory bail to Barnwal, after he had sought relief, as the woman had accused him of rape and had submitted a formal complaint against him.
According to the report, the woman and Ankit had been in a relationship after knowing each other through social media in 2016.
The woman had alleged that at the behest and pressure of Barnwal, she had sought divorce from her husband, which was granted by a family court on March 6.
It was alleged that the woman had asked Ankit to marry her, soon after her divorce, to which he refused.
In a police complaint, she accused him of sexually exploiting her in the false promise of marriage.
The High Court had granted anticipatory bail to Ankit on finding from the record that he had not indulged in any sexual activity with her after her divorce from her husband, the report claimed.
