A Kerala Sessions Court on Wednesday granted anticipatory bail to expelled Congress MLA Rahul Mamkootathil in a second sexual assault case registered against him.
Thiruvananthapuram Sessions Court District and Sessions Judge Nazeera S noted that there was no prima facie material to substantiate the allegations at this stage.
However, the court imposed strict conditions on the Palakkad MLA. He has been directed to appear before the investigating officers every Monday, cooperate fully with the probe, not destroy evidence, and refrain from influencing witnesses.
Mamkootathil had on Saturday approached the Thiruvananthapuram sessions court seeking anticipatory bail in connection with the case. The same day, the Kerala High Court granted him interim protection from arrest in a case of rape and forced abortion, according to news agency PTI.
The MLA’s lawyer, advocate Ajithkumar (Sasthamangalam), said that an anticipatory bail was moved in the sessions court during the day along with an application seeking that police should not proceed with his arrest in view of the high court’s order.
The court noted that the complaint was lodged after an extensive delay of nearly two years, with the complainant giving “different versions" for why the complaint was not filed earlier. It further observed that the Crime Branch had recorded the victim’s statement after registering a First Information Report (FIR). The court did not rule out the possibility of the victim filing the complaint “under pressure".
The court also noted that the victim chose to report to the Kerala Pradesh Congress Committee president rather than file a direct complaint with the police.
The court had earlier dismissed Mamkootathil’s plea for anticipatory bail in relation to another rape case filed against him.
The second rape case was lodged against him on Wednesday based on the complaint of a Bengaluru-based woman, PTI reported. The FIR against Mamkootathil was filed under several sections of the law, including Section 78 (stalking) and 351 (criminal intimidation) of the Bharatiya Nyaya Samhita (BNS), and Section 120(O) of the Kerala Police Act, which deals with harassment through electronic communication.
Mamkootathil had been absconding since the registration of the first rape case against him. He was expelled from the Congress on December 4 after his anticipatory bail plea was rejected by the sessions court.
