Kerala HC sets aside tribunal’s order rejecting Waqf board’s plea

A Division Bench of the Kerala High Court on Tuesday set aside an order of the Waqf tribunal in Kozhikode rejecting the Kerala State Waqf Board’s plea for calling records from the subordinate court, North Paravur in Ernakulam district, regarding the Munambam land dispute cases.

The Bench led by Justice Amit Rawal directed the tribunal to decide afresh the application filed by the Waqf board. The board sought to call for the records on the ground that they had a direct bearing on the pending proceedings relating to the Munambam land before the tribunal.

The court passed the directive while allowing a petition filed by the Waqf board challenging the tribunal’s order.

The court observed that the manner and mode in which the Waqf board’s application was dismissed was not acceptable and sustainable in the eye of law as it did not reflect any arguments or discussions or pleadings or cross-pleading.
