The Kerala High Court on Monday stayed all proceedings related to a notification that was issued on November 5 under the Kerala State Electricity Regulatory Commission (Renewable Energy and Related Matters) Regulations, 2025, for a month.
The court ordered a stay on the operation, implementation, enforcement, and all further proceedings pertaining to the notification. This follows a plea by Domestic On-Grid Solar Power Prosumers Forum-Kerala, challenging the drafting of the new regulations and also the appointment of KSERC members, alleging that the independent body had been captured by the Kerala State Electricity Board (KSEB).
During the hearing of the writ petition on November 3, the KSERC had submitted that it would issue a notification only after considering the objections raised in the course of public hearing, which may require approximately one month, observed a Bench of Justice Mohammad Niaz C.P.
It went on to issue a directive to the State Government, to the KSERC and the KSEB to file counter affidavits regarding the grounds/allegations raised in the writ petition, to enable the court to consider the legality and validity of the November 5 regulations. The matter has been posted for hearing on December 1.
