Indian Railways land encroachment: Indian Railways is moving rapidly to improve passenger experience across the country, while also planning to develop commercial establishments on land under its possession. As of March 31, 2025, the national transporter holds around 4.99 lakh hectares of land nationwide.

However, out of this total, nearly 1,068.54 hectares have been encroached upon in various parts of India for a long period.

In a written statement in Rajya Sabha on December 12, Railway Minister said: “As on 31.03.2025, the total land in possession of Indian Railways is about 4.99 lakh hectares out of which 1068.54 hectares is encroached in various parts of the country for quite a long period.”

Vaishnaw was responding to a question raised by Rajya Sabha MP Dr Laxmikant Bajpayee regarding railway land parcels currently under encroachment across the country. The MP also sought details on how long these land parcels have been encroached upon, the steps taken so far to free them from encroachment, the mechanisms in place to prevent such encroachments and the details of railway land parcels freed from encroachment over the past five years.

Responding to these questions, the Union Minister said that railways carry out regular surveys and take action for their removal. ” In case of encroachments of temporary nature (soft encroachments) in the shape of jhuggies, jhopris and squatters, the same are removed in consultation and with the assistance of Railway Protection Force and local civil authorities,” Vaishnaw said.

The Railway Minister also stated that in cases of old encroachments involving pucca structures, where the occupants are not amenable to persuasion, action is taken under the Public Premises (Eviction of Unauthorized Occupants) Act, 1971.

“For old encroachments which are in the form of pucca structures (hard encroachment), where party is not amenable to persuasion, action is taken under Public Premises (Eviction of Unauthorized Occupants) Act, 1971 (PPE Act, 1971), as amended from time to time. Actual eviction of unauthorized occupants is carried out with the assistance of State Government and local administration/police,” the minister added.
