The Union government is extremely confident of the participation of all members across party lines on the impeachment motion against sitting high court judge Justice Yashwant Varma, following allegations of financial impropriety, in the upcoming monsoon session of Parliament.
Parliamentary affairs minister Kiren Rijiju has already started talking to various opposition leaders in a bid to build consensus. “I have had conversations with all political parties and it is very positive. There is no scope for political bickering on this as it is not a political matter, but a matter of corruption in judiciary, which should unite everyone," Rijiju told CNN-News18.
A 100 MPs need to sign in the Lok Sabha and the Rajya Sabha for the introduction of the motion to impeach the judge. The government is very keen that members of the Opposition also sign the motion which will be brought by law minister Arjun Ram Meghwal.
As per the rules, it is understood that the Lok Sabha Speaker or the Rajya Sabha Chairman need to constitute a committee so that it can submit its report suggesting impeachment of the judge. However, in this case, the report submitted to the government of India and the President already comes with a recommendation of impeachment and therefore, to take the matter up urgently, a legal view will be taken of the powers of the respective Chairs of both Houses to skip the step of setting up a committee.
Justice Varma will also be able to witness his impeachment proceedings sitting right outside the House. “He will be present in Parliament and just outside the House, but cannot enter the House because he’s not a member. But he will be allowed to listen to the proceedings," Rijiju said.
The time that will be given for the discussion on the motion will be decided by the Chairs of both Houses after consulting the business advisory committee.
Opposition parties have also requested that the impeachment of another judge of the Allahabad High Court be taken up for his controversial statements. The Opposition has conveyed to the government that Justice Shekhar Yadav’s case should also be taken up, but it is unlikely the government will take a call on this right now. “This is not a case of hate speech, which adds up to the conduct of the judge, so we are still to take a call on what we are going to do on this matter," Rijiju said.
On Tuesday evening, the government announced that the motion to impeach Justice Varma will be brought in the upcoming Monsoon Session of Parliament. Prime Minister Narendra Modi had made Rijiju in-charge of ensuring consensus on the same. The Monsoon Session of Parliament will convene on July 21 and go on till August 12.
