Rahul Easwar was arrested on Sunday for defaming complaint in Kerala MLA rape case.
The Principal District and Sessions Court in Thiruvananthapuram on Monday granted bail to YouTuber and television commentator Rahul Easwar in connection with a cyber harassment case linked to the Rahul Mamkootathil controversy.
Easwar was arrested by the Thiruvananthapuram Cyber Police following a complaint by a woman who had earlier accused Palakkad MLA Rahul Mamkootathil of rape and forced termination of pregnancy.
The case against Easwar pertains to the alleged disclosure of the survivor’s identity and making derogatory remarks about her on social media platforms.
Earlier, an Additional Chief Judicial Magistrate had remanded Easwar to police custody after rejecting his bail plea.
The court had noted the seriousness of the allegations, particularly the violation of legal safeguards protecting the identity of survivors of sexual offences.
According to the police, Easwar is the fifth accused in the case. Others named include KPCC general secretary Sandeep Varier, Mahila Congress Pathanamthitta district general secretary Renjitha Pulickan, and advocate Deepa Joseph.
Proceedings related to anticipatory bail sought by Varier are still pending before the sessions court.
During the bail hearing, Easwar’s counsel argued that he had merely referred to contents of the FIR and expressed willingness to remove the disputed social media post.
The prosecution, however, opposed bail, stating that Easwar had not cooperated with the investigation and had a history of making remarks that allegedly targeted survivors in sexual offence cases, which could have wider social repercussions.
Following his arrest, Easwar’s health reportedly deteriorated while he was in judicial custody.
He was shifted to the government medical college hospital after observing a hunger strike in protest against his detention, on the recommendation of jail authorities and attending doctors.
With the grant of bail, Easwar is expected to be released subject to conditions imposed by the court, while the investigation in the case continues.
