Supreme Court agrees to take up plea challenging SIR exercise on November 11

Supreme Court on Friday (November 7, 2025) agreed to urgently start hearing the Special Intensive Revision (SIR) case on November 11 at 11.15 a.m, and if necessary to continue hearing it on November 12.

A Bench of Justices Surya Kant and Joymalya Bagchi agreed to also hear on November 11 a fresh application filed by the State of West Bengal, represented by senior advocate Kapil Sibal, challenging the SIR exercise.

Mr. Sibal and advocates Prashant Bhushan and Neha Rathi, for petitioner Association for Democratic Reforms, said the case goes to the roots of the country’s democratic principles and Aadhaar is not being accepted by electoral authorities.

Mr. Bhushan referred to the expansion of SIR to other States, and the undermining of the election process by the Election Commission itself.

“This is the most important case. It affects the very roots of our democracy,” Mr. Bhushan submitted in an oral mentioning.

Separately, the DMK, in its plea before the Supreme Court against the SIR, has dubbed it a “de facto NRC” and has challenged its constitutional validity. The ruling party in Tamil Nadu has sought the quashing of the EC’s notification on SIR dated October 27, 2025.

The Supreme Court was scheduled to hear on the constitutionality of the Bihar SIR on November 4. However, both Justices Surya Kant and Joymalya Bagchi, who formed the Bench hearing the case, were part of a Constitution Bench and did not assemble on Tuesday.
