BMC Compensation Structure
Under the official BMC compensation policy, payouts are categorised by the severity of the impact:
Loss of Life: The next of kin of a deceased victim is eligible for a baseline compensation of ₹1 lakh.
Permanent Disability: Victims who suffer a life-altering disability from a tree collapse receive ₹50,000.
Medical Expenses: The BMC will cover the full medical treatment costs for injured victims, provided they receive treatment at a municipal hospital.
Discretionary and Case-by-Case Enhancements
Because the standard framework offers limited financial support, the State Government and the BMC frequently announce higher, ex gratia (discretionary) relief payouts for high-profile or severe monsoonal tragedies.
In notable instances, the Chief Minister’s office or political representatives have intervened to scale up immediate aid — ranging from ₹2.5 lakh to ₹4 lakh — for the families of deceased victims.
If a tree collapse happens inside a private residential housing society or at a commercial construction site due to neglected maintenance, the property owners or private developers can be held legally liable. In past landmark rulings, Mumbai courts have ordered housing societies to pay up to ₹20 lakh in damages to the families of individuals killed by falling trees on their premises.
Legal Context: Trees Falling on Vehicles
If a roadside tree branch falls on a stationary or moving vehicle (such as an autorickshaw or car), victims have historically tried to claim compensation under the Motor Vehicles Act (MVA). However, the Supreme Court of India has clarified that a tree-fall incident cannot be treated as a motor vehicle accident because the vehicle itself does not play an active role in causing the mishap.
Even so, the Supreme Court has imposed substantial compensation on local municipal bodies for negligence in tree maintenance, invoking extraordinary constitutional powers to award up to ₹25 lakh to severely paralysed victims to ensure comprehensive justice.
How to claim compensation?
- File an ADR/FIR: Ensure the local police station registers an Accidental Death Report (ADR) or a formal station diary entry detailing the tree collapse.
- Approach the Ward Office: Submit a formal compensation application to the local BMC Ward Officer or the Garden Superintendent’s office.
- Submit Medical Records: Provide hospital admission files, treatment bills, or a post-mortem report to the civic committee evaluating the claim.
