New Delhi: There is now a broader debate on how online reviews are judged and how free speech is being protected, mainly because of a legal battle between AI+ Smartphones and a few of India’s biggest tech-heads on the YouTube platform. This case has now created a larger discussion surrounding online reviews, freedom of expression and the rise of using legal action to take down content creators.
In a riled up debate, the Delhi High Court had earlier issued an interim order barricading popular YouTube channels ‘TechWiser’ and ‘TechBar’ from posting content that may be disparaging towards AI+ Smartphones and its founder Madhav Sheth. The order came after the NxtQuantum Shift Technologies behind AI+ Smartphones filed a suit accusing some videos of hurting the company’s reputation. The company claimed that the creators’ videos were made with remarks that demean the company name, jeopardize consumer trust and the business’s interests, according to court documents. Justice Tushar Rao Gedela read the documents and issued an interim restraining order without considering what the YouTube users said.
The court blocked TechWiser, TechBar, and even any future possible party to make such content “disparaging” of AI+ smartphones on YouTube or on other digital platforms “defamatory” to TechWiser, TechBar and the other two. The order stemmed from the court’s belief that a prima facie case had been made against the company and it must be taken down for irreparable harm or further damage to the company.
The move soon garnered passion in India’s tech-gondola. A number of authors and digital pundits signaled their worry about the regulation of critiques and evaluations of products using legal action. Several observers had expressed the opinion that investigating company claims, testing products, and challenging marketing claims are valuable and essential components of independent technology journalism and consumer consciousness. That got even more problematic as the court order reportedly contained an “Ashok Kumar/John Doe” clause. These clauses are normally implemented when it’s not possible to think of potential defendants beforehand. Proponents of such actions say the lawsuits would apply to users of Internet discussion boards even if their names were not specifically mentioned.
