The Chhattisgarh High Court has held that ejaculation without penetration constitutes an attempt to commit rape and does not amount to the offence of rape, while modifying a conviction delivered nearly two decades ago.

The ruling was delivered by Justice Narendra Kumar Vyas, who was hearing an appeal against a 2005 trial court judgment sentencing the accused to seven years’ imprisonment for rape.

The case dates back to 2004. The trial court had found that the accused had committed sexual intercourse against the will of the victim. However, during cross-examination, the victim stated that the accused had kept his private part above her vagina but had not penetrated it, Bar and Bench reported.
