The Gujarat government has moved to amend marriage registration rules, proposing that couples must formally state that they have informed their parents before their marriage application can be processed, officials said.
Deputy Chief Minister Harsh Sanghavi introduced the draft changes in the Gujarat Legislative Assembly, pitching them as part of efforts to improve transparency in marriage registrations and address concerns over alleged misuse of existing norms. Under the proposal, couples seeking to register their marriage would be required to submit an undertaking confirming whether their parents have been notified.
Once an application is lodged, the assistant registrar would be responsible for informing the parents of both the bride and groom either electronically, including via WhatsApp, or through physical communication within 10 working days. Registration would be granted after a verification period of up to 30 days, with all submitted details uploaded to a government portal.
Sanghavi insisted the proposal is not aimed at restricting love marriages but at preventing deception and protecting dignity in matrimonial arrangements. He cited instances from districts such as Panchmahal where, he claimed, questionable marriage certificates had been issued.
The move drew backing from some legislators and community groups, including representatives of the Patidar and Kshatriya Thakor communities, and support from the Aam Aadmi Party. The Congress has so far remained silent on the proposal.
However, legal experts have raised concerns that mandatory parental notification could infringe on adults’ constitutional right to marry freely, protected under Article 21 of the Constitution, and may face judicial challenges if enacted.
The government has invited public feedback on the draft changes for over 30 days before finalising the rules.
