HC rejects contractor bail

New Delhi: Despite being informed about the death of a 25-year-old motorcyclist who fell into an uncovered excavation pit, contractor Himanshu Gupta took no steps to alert police or assist the victim, Delhi High Court noted on Thursday while dismissing his bail plea.The court was hearing Gupta’s second bail application in connection with the February death in Janakpuri, allegedly caused by negligence.“Therefore, the present case is one where a deep excavation was carried out on a busy public road without adherence to mandatory safety measures… resulting in a tragic and preventable loss of life,” Justice Swarana Kanta Sharma observed.The court added that material on record shows that despite being informed the same night, neither Gupta nor the sub-contractor informed police or arranged medical help, with allegations of attempts to cover up lapses at the site.It also noted that Gupta was apprised of the incident soon after it occurred and remained in contact with the sub-contractor but failed to act.The case relates to Kamal Dhyani, an HDFC Bank employee, who died on February 5 after his motorcycle fell into a 15-foot-deep sewage pit allegedly left open during Delhi Jal Board work.
