A court in Karnataka ordered the registration of an FIR against senior officials of KLM Royal Dutch Airlines after a family of eight was allegedly denied boarding at the last minute at Bengaluru airport, despite holding valid tickets worth around Rs 49 lakh. The incident dates back to June 2024, when the family was scheduled to travel from Bengaluru to Peru. They had booked eight non-refundable business class tickets, with a return journey planned for July 3.

According to the complaint, the family arrived at the airport well in advance and completed initial formalities. However, after waiting at the check-in counter for several hours, they were informed shortly before departure that they would not be allowed to board the flight.

Can You Get A Refund If Denied Boarding?

In India, passengers who are denied boarding are usually entitled to a refund and often compensation but this depends on the reason for the denial. Under the Directorate General of Civil Aviation (DGCA) rules, the key factor is whether the airline is at fault.

If the airline is at fault and boarding is denied due to reasons attributable to the airline- such as overbooking or operational decisions- passengers must be offered either a full refund or an alternative flight. In addition, they are typically entitled to compensation, depending on the delay involved. If the alternate flight is significantly delayed, the airline may also be required to provide meals, refreshments and even hotel accommodation.

What Happens If Flyer Gives Up Seat Voluntarily?

If you give up your seat voluntarily, in cases where airlines seek volunteers due to overbooking, passengers can negotiate benefits such as cash compensation, vouchers or upgrades. They are still entitled to a refund or rebooking options. If the denial of boarding is due to the passenger, compensation is generally not applicable as in such cases, refunds depend on the ticket type and many tickets may be non-refundable.
