Despite Justice Yashwant Varma submitting his resignation, the government is likely to continue with proceedings to remove him from office, according to sources. Sources said Justice Varma’s resignation has not yet been formally accepted by the President. Government insiders indicated that the Centre is keen to take the matter to its logical conclusion even after the resignation, in an attempt to send a strong message on judicial accountability and institutional transparency.
Justice Varma has been at the centre of controversy following allegations that triggered calls for action against him. The matter gained further significance after a special inquiry committee was constituted to examine the charges against the judge. The committee has already submitted its report to Lok Sabha Speaker Om Birla. While the contents of the report have not been made public so far, sources said the allegations mentioned in it have been treated with utmost seriousness by the authorities.
According to sources, the government may move an impeachment motion against Justice Verma during the upcoming Monsoon Session of Parliament. Under the Constitution, a Supreme Court or High Court judge can be removed only through a parliamentary process requiring a special majority in both Houses. The move would make the case one of the rare instances in India where impeachment proceedings against a sitting judge are formally pursued.
