Khan is currently five months pregnant. The court noted that the agony and social stigma of giving birth inside a prison are unbearable for any woman.

The judge explicitly remarked, “No one should be made to endure the trauma, or the social stigma associated with a child being born in prison, as in the case of Lord Krishna," using the context to exercise judicial discretion for the welfare of the unborn child.

The court ruled that since the police investigation is complete and the chargesheet has been filed, her continued custody served no immediate purpose.

Nida Khan was arrested on May 7, 2026, following allegations involving a BPO unit of Tata Consultancy Services (TCS) in Nashik.

The prosecution claimed Khan and others targeted a female colleague, making derogatory remarks about Hindu deities, providing her with a burqa, and training her in Islamic practices as part of a forced religious conversion and workplace harassment attempt.
